1. Applicability

1.1 These Terms apply to all products, services, digital publications, and information offered or sold via the OHI website.
1.2 By placing an order or entering into any agreement with OHI, the customer accepts these Terms and Conditions.
1.3 Deviations from these Terms are valid only if confirmed in writing by OHI.

2. Definitions

  • OHI – Olive Health Institute, the provider of products and services.

  • Customer – any natural or legal person purchasing goods or services from OHI.

  • Agreement – any purchase, collaboration, or other contractual relationship between OHI and the Customer.

  • Products – physical goods (e.g., olive-related supplements, books, publications) or digital content (e.g., reports, e-books).

  • Services – research participation, consultancy, events, or educational activities.

3. Offers and Prices

3.1 All offers and prices are non-binding and include VAT unless stated otherwise.
3.2 OHI reserves the right to change prices, product details, or specifications at any time.
3.3 Obvious errors or misprints do not bind OHI.
3.4 Promotions and discounts apply while stocks last or for the stated period only.

4. Orders and Conclusion of Agreement

4.1 An agreement is formed once the customer places an order via the webshop and receives written confirmation from OHI.
4.2 If OHI cannot fulfil an order (e.g., stock issues or address errors), the customer will be notified and refunded.
4.3 OHI reserves the right to refuse orders in case of suspected misuse or fraud.

5. Payment

5.1 Payments are made in advance via the offered payment methods (iDEAL, credit card, PayPal, or bank transfer).
5.2 Orders will only be processed after full payment has been received.
5.3 Business customers may request an invoice with a 14-day payment term unless otherwise agreed.
5.4 In case of late payment, statutory interest and collection costs may be charged.

6. Delivery

6.1 Deliveries are made to the address provided by the customer.
6.2 Typical delivery time: 3–7 business days (NL/BE) or 7–14 days (international), unless specified otherwise.
6.3 If delivery is delayed, OHI will inform the customer promptly.
6.4 Digital products (e.g., reports or e-books) are supplied via download link or e-mail.
6.5 Risk of loss or damage passes to the customer upon delivery.

7. Right of Withdrawal (consumers)

7.1 Consumers have the right to withdraw from a purchase within 14 days of receiving the goods, without giving reasons.
7.2 During this period, the customer must handle the product carefully and return it in its original condition and packaging.
7.3 Exceptions – the right of withdrawal does not apply to:
 • Digital downloads or e-books once download has begun;
 • Opened food supplements or nutrition products;
 • Personalised or custom-made items.
7.4 Returns must be announced in advance via info@olivehealthinstitute.com, quoting the order number.
7.5 After receipt of the returned item, OHI will refund the purchase amount within 14 days.

8. Warranty and Quality

8.1 OHI guarantees that its products meet reasonable quality standards and correspond to their online description.
8.2 Defective or damaged items must be reported within 7 days of receipt.
8.3 Depending on the situation, OHI will replace, repair, or refund the product.
8.4 Warranty does not apply in cases of improper use, incorrect storage, or unauthorised modifications.

9. Liability

9.1 All content on the OHI website is prepared with care; however, OHI cannot guarantee absolute accuracy.
9.2 OHI is not liable for indirect or consequential damages or loss of profit.
9.3 OHI's total liability is limited to the amount paid by the customer for the specific product or service.
9.4 Health-related products (supplements or olive extracts) are not medicines. Information on the website does not replace medical advice. Always consult a physician when in doubt.

10. Intellectual Property

10.1 All texts, images, logos, publications and designs on the website are the property of OHI or its partners.
10.2 Reproduction or distribution of any material without prior written permission is prohibited.

11. Force Majeure

11.1 In cases of force majeure (pandemic, natural disaster, fire, transport issues, government restrictions, etc.), OHI may suspend or terminate the agreement without liability for damages.

12. Complaints and Dispute Resolution

12.1 OHI strives for customer satisfaction. Complaints can be sent to info@olivehealthinstitute.com.
12.2 OHI will respond within 14 days.
12.3 If the complaint cannot be resolved, consumers may submit it to the Webshop Disputes Committee (Thuiswinkel.org) or the competent court in the Netherlands.

13. Applicable Law and Jurisdiction

13.1 All agreements are governed exclusively by Dutch law.
13.2 Disputes will be resolved preferably through consultation; if unresolved, the District Court of Rotterdam has jurisdiction.
